Welcome to Dusted. These Terms of Service ("Terms") cover your use of the Dusted mobile application and related services provided by Lowen Logic Pty Ltd ("we", "us", or "our").

By creating an account or using the app, you agree to these Terms. If you do not agree, you must not use the app.

1. The Service

Dusted is a utility tool designed to help tradespeople and construction professionals track work hours and site attendance. While we strive for accuracy, the app is provided as a tool to assist you, not as a replacement for professional accounting, legal, or payroll advice.

2. Your Account

• You must provide accurate information when creating an account.
• You are responsible for keeping your password and account details secure.
• You are responsible for all activity that occurs under your account.

3. User Content

You retain ownership of the data you enter into Dusted (e.g., timesheets, notes, job names). By using the app, you grant us a licence to host, store, and display this content solely for the purpose of providing the service to you.

4. Acceptable Use

You agree not to:

• Use the app for any illegal purpose or in violation of any local laws.
• Attempt to reverse engineer, decompile, or copy the app's source code.
• Use the app to transmit viruses, malware, or harmful code.

5. Disclaimers (Important)

Dusted is provided "AS IS" and "AS AVAILABLE".

To the maximum extent permitted by law, Lowen Logic Pty Ltd explicitly disclaims all warranties, express or implied.

• We do not guarantee that the app will be error-free, uninterrupted, or 100% accurate at all times.
• We are not responsible for any financial losses, under-quoting, payroll errors, or tax discrepancies resulting from your reliance on the data provided by the app. You verify your own hours before billing clients.
• Data Loss: While we perform backups, we are not liable for the loss of any content or data. We recommend you export your data regularly.

6. Limitation of Liability

To the extent permitted by Australian Consumer Law:

• Lowen Logic Pty Ltd will not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or goodwill).
• Our total liability for any claim arising out of these Terms or the app is limited to the amount you paid us to use the app in the past 12 months, or AUD $50.00, whichever is greater.

7. Termination

We may suspend or terminate your access to Dusted at any time, with or without cause, specifically if we believe you have violated these Terms. You may delete your account at any time via the app settings.

8. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes relating to these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.
